RULES OF PROCEDURE BEFORE THE HEARING EXAMINER On March 11, 2008, the Port Orchard City Council approved a land use decision-making process to hold public hearings in front of a Hearing Examiner. The Hearing Examiner's decisions and recommendations are based in compliance with the City's ordinances and regulations. Findings of fact must be made, and the decisions or recommendations must be supported by evidence. The hearing is a "quasi-judicial" process where evidence is presented in the form of documents and/or sworn testimony. At the end of the hearing, the record is officially closed. On occasion, the Hearing Examiner will keep the record open past the public hearing, awaiting additional documents or information. Within 10 working days the Hearing Examiner will issue his determination. Depending on the type of permit, the Hearing Examiner may issue a decision, or a recommendation to the City Council for their decision.
