Dispensaries and Collective Gardens The Dispensing of Medical Marijuana and the cultivation of collective Medical Marijuana gardens has been approved by the State of Washington in 2011 (Please refer to the Washington State website links below). Absent specific State regulations on the subject, local jurisdictions have been delegated the residual authority for the administration of land use and regulatory issues relating to the matter. The Port Orchard City Council presently has adopted a temporary moratorium that prohibits the acceptance of any permits that relate to the selling or dispensing of Marijuana/Cannabis for medical purposes. Additionally the City Council has adopted a temporary moratorium that prohibits collective gardens within City limits. Both measures were adopted to allow time for the public process to occur for drafting possible land use and regulatory measures to ensure that the City is consistent with Washington State law. Some may consider this a slow process, but please note that any Port Orchard Municipal Code or land use regulations require a minimum of 60 days public comment period prior to implementation. The Planning Department has been tasked with providing draft alternatives for both the Port Orchard Planning Commission and Port Orchard City Council to consider. The process for a draft land use code is available for public review and comment, and the alternatives are intended to assist in the orderly location and regulation of these facilities in a manner that endeavors to preserve the health, safety, and welfare of the City of Port Orchard while maintaining consistency with Washington State law.
