Description of Proposed Project:

The proposal consists of a site-specific rezone of the subject property from Commercial Mixed Use (CMU) to Business Professional Mixed Use (BPMU). The subject property is currently developed with a single-family detached house which is not a permitted use in the CMU district. The BPMU designation allows detached houses as a permitted use and office uses but does not allow certain more intense uses otherwise permitted in the CMU district.


Preliminary State Environmental Policy Act (SEPA) Determination:

The City of Port Orchard has reviewed the proposed project for probable adverse environmental impacts and expects to issue a determination of nonsignificance (DNS) for this project. The optional DNS process in WAC 197-11-355 is being used, consistent with POMC 20.160.

The proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared.

Public Comment Period and Appeals:

Any interested person may comment on this application. The comment period will remain open for 14 days. The deadline to submit comments is December 20, 2019. Any interested person may request notification of any hearings or meetings and request a copy of the decision once made. Requests must be addressed to City of Port Orchard Permit Center, Attn: Planning Clerk, 216 Prospect Street, Port Orchard, WA  98366, 360.874.5533.

Any interested party may appeal a Type IV decision to the Superior Court within 14 calendar days of the Notice of Decision. The Notice of Decision will be provided to all parties of record.

The application file may be examined at the Permit Center, 720 Prospect Street, Port Orchard, WA  98366, by appointment between the hours of 8 AM and 4 PM, Monday through Friday, except holidays.
